AN ACT TO ADD A NEW §90.50 TO 9 GUAM CODE ANNOTATED, CHAPTER 90, RELATIVE TO ESTABLISHING AND ADMINISTERING AN INTERNATIONAL PRISONER TRANSFER PROGRAM.
Sam introduced Bill 469 – an Act related to establishing and administering an international prisoner transfer program.
Sam has found that pursuant to the International Prisoner Transfer Program, established under treaties since 1976, foreign nationals from participating countries who are serving sentences in the United States may be transferred to their home country to serve the remainder of their sentences.
She also discovered that the territory of Guam is entitled to adopt legislation authorizing the transfer of foreign nationals who have been convicted and sentenced in state and territorial courts. This would align Guam with the Commonwealth of the Northern Mariana Islands, Puerto Rico, and all fifty states. Implementing a prisoner transfer program for Guam would assist the United States in meeting its treaty obligations, as concurred by the U.S. Department of Justice.
This transfer program would include neighboring Asian and Pacific nations, such as Hong Kong, Japan, the Marshall Islands, Federated States of Micronesia, Republic of Palau, Thailand, and Tonga.
The program would contribute to improving rehabilitative opportunities for those transferred to their home country. With a reduction of inmate detainees at the Department of Corrections Adult Detention facilities, GovGuam would also benefit from significant cost-savings and more effective and safer operations
